Aiming to improve ease of doing business, clear regulatory bottlenecks, and give consumers quicker access to advanced healthcare technology, the Union Ministry of Health and Family Welfare has notified fresh amendments to the Medical Devices Rules, 2017.
Two changes stand out for manufacturers and importers, Rule 44 drops the loan license requirement for outsourced sterilisation, while Rule 63 brings the European Union into the clinical trial waiver list.
Manufacturers relying on third-party sterilisation facilities, as long as those facilities hold a valid license under the 2017 Rules, will no longer need a separate loan license.
Administrative duplication, compliance costs, and manufacturing timelines all come down as a result, a welcome relief for med-tech startups and smaller manufacturers without their own sterilisation setup.
With this amendment, the European Union takes its place alongside the US, UK, Australia, Canada, and Japan as a recognised stringent regulatory jurisdiction. Devices with no predicate in India that already carry EU approval can now claim clinical investigation waivers, cutting down the time it takes to bring advanced European medical technology to Indian buyers.
